Pre-launch notice — RoadbookX is not yet available on the App Store. Newbold Tech is a newly established sole proprietorship currently in its pre-launch phase. This website and these Terms are published for transparency and informational purposes only. No binding agreement is formed by viewing this page. These Terms will govern use of the App when it becomes publicly available.

These Terms and Conditions ("Terms") govern your use of the RoadbookX mobile application ("App"), operated by Newbold Tech, a sole proprietorship ("we," "us," or "our"). By downloading, accessing, or using RoadbookX, you agree to these Terms. If you do not agree, do not use the App.

1. Purpose of RoadbookX

RoadbookX is a recreational mountain-bike navigation and route-recording application inspired by rally-style navigation. It is intended as a supplemental recreational navigation tool. It is not a safety device, emergency service, professional navigation system, or substitute for appropriate judgment and preparation.

2. Mountain Biking Is Inherently Dangerous

Mountain biking, cycling, trail riding, and outdoor recreation involve inherent risks that may result in property damage, serious injury, permanent disability, or death. By using RoadbookX while participating in these activities, you voluntarily assume these risks to the fullest extent permitted by applicable law.

3. Do Not Rely Exclusively on RoadbookX

RoadbookX should never be your sole means of navigation. GPS, compass, elevation, distance, waypoint, roadbook, and other navigation information can be inaccurate, delayed, unavailable, or affected by environmental and technical conditions. Always carry appropriate backup navigation and emergency equipment.

4. Trail Conditions Can Change

RoadbookX cannot guarantee that a recorded route, roadbook, waypoint, or hazard reflects current conditions. Always evaluate actual conditions yourself. Real-world conditions take priority over anything displayed by RoadbookX.

5. User-Generated Routes and Roadbooks

RoadbookX may allow users to create, import, export, and share routes, roadbooks, waypoints, voice transcriptions, GPX files, and other information. Newbold Tech does not independently inspect, verify, or guarantee User Content. You are responsible for deciding whether a route is appropriate for you.

6. Rally Hazard Ratings

Hazard indicators (! Caution, !! Significant, !!! Severe) are informational only. The absence of a hazard symbol does not mean a trail or section is safe.

7. Trail Difficulty Ratings

Difficulty ratings (Green, Blue, Black, Double Black) are subjective and vary between trail systems, riders, and conditions. Never attempt a trail solely because RoadbookX displays a particular rating. Ride within your abilities.

8. Safe Use While Riding

Do not interact with RoadbookX in a manner that distracts you from safely controlling your bicycle. Whenever practical, stop in a safe location before entering information, editing a roadbook, recording a voice memo, or performing other tasks requiring significant attention. You are solely responsible for safely operating your bicycle.

9. GPS Route Recording

GPS information is inherently subject to error. Recorded tracks may contain drift, incorrect coordinates, missing points, incorrect distances, elevation, speed, or headings. Do not assume that a recorded route precisely represents the path actually traveled.

10. Voice Memos and Speech Recognition

Speech recognition is not guaranteed to be accurate. You are responsible for reviewing transcribed navigation instructions before relying upon or sharing them.

11. Trail Access and Private Property

A route appearing in RoadbookX does not establish that the public has a legal right to travel through that location. You are responsible for obeying posted signs, respecting trail closures, obtaining required permits, and following applicable laws. Never trespass based on information displayed in RoadbookX.

12. Ownership of Routes and User Content

Content you create and store locally

Routes, roadbooks, voice recordings, notes, and other content you create and store on your device remain under your ownership. RoadbookX's ability to store, process, or export that content on your device does not transfer ownership of your locally stored content to Newbold Tech. You are free to export, delete, or use your locally stored content as you see fit.

Content you share through RoadbookX

When you choose to share, submit, or transmit content through RoadbookX or any RoadbookX platform, community feature, or service, you grant Newbold Tech a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce, modify, adapt, publish, distribute, and sublicense that content for any purpose. Newbold Tech retains ownership rights in content submitted to or hosted by RoadbookX platforms.

Sharing content through RoadbookX does not delete your local copy or prevent you from continuing to use, modify, or export your own locally stored routes and recordings. Once shared, however, Newbold Tech's rights in that shared content are independent of any continued or discontinued use of the App.

13. RoadbookX Intellectual Property

The RoadbookX application, including its software, design, graphics, branding, and original content supplied by Newbold Tech, is owned by or licensed to Newbold Tech. These Terms do not grant you ownership of RoadbookX or its underlying software.

14. No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROADBOOKX IS PROVIDED "AS IS" AND "AS AVAILABLE." NEWBOLD TECH DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ROADBOOKX WILL BE ERROR-FREE OR THAT NAVIGATION INFORMATION WILL BE ACCURATE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEWBOLD TECH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM OR RELATING TO YOUR USE OF ROADBOOKX, INCLUDING DAMAGES ARISING FROM PERSONAL INJURY, NAVIGATION ERRORS, TRAIL CONDITIONS, USER-GENERATED ROUTES, LOST OR CORRUPTED DATA, OR INABILITY TO ACCESS THE APP.

16. Apple

If RoadbookX is downloaded through Apple's App Store, these Terms are between you and Newbold Tech, not Apple Inc. Apple is not responsible for RoadbookX or its content.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

18. Changes to These Terms

We may update these Terms periodically. When required, updated Terms will be presented within the App. Continued use following the effective date of updated Terms constitutes acceptance to the extent permitted by law.
